Frequently Asked Questions

• When will Premium Processing resume for H-1B petitions?
On July 24, 2017, USCIS issued a news release that it would resume premium processing for certain cap-exempt H-1B petitions effective immediately.

Premium processing will resume for petitions that may be exempt from the cap if the H-1B petitioner is
* An institution of higher education;
* A nonprofit related to or affiliated with an institution of higher education; or
* A nonprofit research or governmental research organization.

Premium processing will also resume for petitions that may also be exempt if the beneficiary will be employed at a qualifying cap-exempt institution, organization, or entity.

Premium processing resumed on June 26 for H-1B petitions filed on behalf of physicians under the Conrad 30 waiver program as well as interested government agency waivers.

USCIS plans to resume premium processing of other H-1B petitions as workloads permit.

How can I renew my green card? Do I have to apply for U.S. Citizenship?
You do not have to apply for U.S. citizenship if you do not wish to do so. However, you do need to renew your green card if it is expiring, as you will not be able to renew your driver’s license in most states without it. You can renew it by filing form I-90 with USCIS. A new mobile app to renew your green card allows lawful permanent residents, who file the online Form I-90 without assistance from an attorney, to file their form and upload evidence entirely on a mobile device.

Instructions for filing Form I-90 require providing certain evidence, such as a copy of government-issued identification. For those filing through a mobile device, it may be easier to take a photo of the evidence and upload it directly from their mobile devices. The redesigned online form also provides a more personalized experience, as users are directed to answer only those questions specific to their case.

There are no substantive changes to the policy or content of the form, and the online version has parity with the questions and content on the paper form.

Customers who wish to file Form I-90 with the assistance of an attorney or accredited representative will continue to use the previous version of the online Form I-90.
