Frequently Asked Questions
• I have had a U visa for several years and want to
apply for a green card now. What are the guidelines and/
or requirements? Is there an interview?
You are eligible to apply three years from the date you
received your U visa approval (not three years since your
deferred action approval letter). The process is taking about
6 months. There is generally no interview. Family members
(derivatives) in the U.S. must also meet these requirements,
if they hold U visa status. There are separate procedures for
family members who never held U status.
To apply, you must meet the following conditions:
1. You have been physically present in the U.S. for a
continuous period of at least 3 years since the first date of
admission as a U nonimmigrant and continue to hold that
status at the time of application for adjustment of status.
2. You have not unreasonably refused to provide assistance
in the criminal investigation or prosecution.
3. You are not inadmissible under section 212(a)(3)(E) of
the Immigration Nationality Act.
4. You establish that your presence in the United States
is justified on humanitarian grounds, to ensure family
unity, or is in the public interest.
Forms have been updated for U visa Supplement B, for I-485 (green card), and for I-918 (U visa). Use USCIS website's latest forms so your petition will not be rejected.
• I am 18 years old and am eligible for a U visa. Can I
sponsor my parents or siblings?
If you are under 21 (20 or younger), you may petition
for your spouse, children, parents, and unmarried siblings
under age 18. If you are 21 or over, you may only petition
for spouse and unmarried children under 21.
• I don't speak English very well. Who can I take as an
interpreter for my green card interview?
An individual must be sufficiently fluent in both English
and in the interviewee’s language, able to interpret competently,
impartially, and without bias. If the officer determines
before or during the interview that an individual
can’t meet these standards, the officer must disqualify the
individual from being an interpreter. An exception may be
granted for good cause.
Minors under age 18, witnesses, attorneys, and representatives for the interviewee are restricted from being an interpreter, but an exception may be granted if the proposed interpreter is aged 14-17. Family members may be considered not impartial, so the safest option is to take someone unrelated, or not a close family friend. This memo does not apply for asylum interviews.
