New F-1 rules bring big changes for students

International students planning to study in the U.S. should be aware of several important changes affecting the F-1 visa program. The Department of Homeland Security (DHS) recently finalized new regulations that replace the long-standing “duration of status” (D/S) model with fixed periods of admission for many F-1 students. Under the new framework, most students will be admitted for a set period — generally up to four years — rather than remaining in status for as long as they continue their academic program. Students who need additional time to complete their studies must apply for an extension before their authorized stay expires. Failure to timely request an extension could result in a loss of status and potential accrual of unlawful presence.

The changes are intended to strengthen oversight of the student visa program, but they also place greater responsibility on students to closely monitor their immi- gration status and deadlines. Our clients currently on F1 status are reporting that their schools are allowing them a one-time opportunity to meet with their international student office and extend their I-20 until the end of their program period. This must happen before September; after which, I-539 petitions would have to be filed at USCIS in order to do the status extensions. The rule also cuts the departure grace period in half. Students with F-1 visas now have 30 days rather than 60 to prepare to leave the country, transfer schools, or change their status following graduation.

The new rule states that OPT (Optional Practical Training) is now part of the four-year period of stay, so in order to perform OPT beyond that four year limit, students would need to file USCIS petitions for extensions of stay. Students participating in OPT or STEM OPT should continue to comply with all reporting and employment requirements. Timely reporting of employment information and adherence to program rules remain essential to preserving lawful status.

What nonimmigrants must know before leaving U.S.

One of the most important considerations is visa validity. Even if a person’s immigration status remains valid, an expired visa stamp generally requires obtaining a new visa from a U.S. consulate abroad before returning. Applicants should also be aware that visa appointments may be limited in some countries and that administrative processing can extend the time required for visa issuance. Before traveling, foreign nationals should confirm they have a valid passport, original approval notices (when applicable), recent employment verification letters, and supporting documentation demonstrating continued eligibility for their visa classification. Students should ensure that their Forms I-20 contain current travel endorsements, while employment-based visa holders should verify that their employment information remains accurate.

Travelers should also remember that every admission into the U.S. is subject to inspection by U.S. Customs and Border Protection. Although the vast majority of travelers experience routine inspections, carrying complete documentation can help avoid unnecessary delays. Individuals with pending immigration applications — including adjustment of status applications, change of status requests, or certain employment authorization applications — should consult with experienced immigration counsel before departing the U.S., as international travel may affect pending filings or require advance authorization.
